  1. SIERRA DIVING ADVENTURE screen saver is a real-time 
  2. 3D simulation of an undersea environment that allows 
  3. you to swim with the fishes. It is a prototype for a 
  4. product being considered for development at Sierra.  
  5. We welcome any feedback you may wish to provide that 
  6. will help us to make Diving Adventure a truly

  13. IMPORTANT
  14. You must accept the terms in the license agreement at 
  15. the end of this document prior to installing this 
  16. software. Please read them carefully.  Installing this 
  17. software indicates that you agree to the terms of the 
  18. license.

  20. INSTALLATION
  21. 1. Copy Diving.scr, Diving.wav, Diving.ted and 
  22. Diving.vol from the directory "\s\scuba\product" 
  23. on your CD-ROM drive into the Windows directory
  24. on your hard drive.
  25. 2. Right click on the Win '95 desktop and select 
  26. "properties".
  27. 3. Select "Screen Saver" and go through the setup 
  28. procedures as usual.  "Diving" will be one of the 
  29. selections in the screen saver list box. 
  30.  
  31. NOTE:  There is no PASSWORD option in this screensaver.
  32.        Checking the Password box will do nothing.
  33.  
  34. DIVING requires 2.3 meg of free HD space.
  35.  
  36. CONTROLS
  37. DIVING is an INTERACTIVE screen saver which allows 
  38. you to either control your movement through the water 
  39. or sit back and watch in "fish cam" mode. Movement is 
  40. controlled with the mouse. Forward and reverse speed 
  41. is controlled with the left and right mouse buttons 
  42. respectively. The longer the mouse buttons are 
  43. depressed the faster you will go. If you become lost or 
  44. disoriented simply release the mouse for 10 seconds 
  45. and you will be returned to the starting position.  To end 
  46. the screen saver, press a key on the keyboard.

  51. NOTE:  By using the "Diving" program (the "Program"), 
  52. you signal your acceptance of the following terms and 
  53. conditions.  If you do not agree to these terms and 
  54. conditions, you may not use this Program in any 
  55. manner.

  57. License.  Sierra grants you, the end-user, a revocable, 
  58. nonexclusive, nontransferable license to use this copy of 
  59. "Diving" program (the "Program"), in object code form only, 
  60. on your personal computer.  You may not: (a) disassemble, 
  61. reverse engineer, recompile, decompile or otherwise attempt 
  62. to discover the source code of the Program; (b) make any 
  63. adaptation, modification, improvement, enhancement or 
  64. derivative of the Program; (c) reproduce or distribute the 
  65. Program; (d) remove, obscure or alter any notice of 
  66. copyright or other proprietary right present on or in the 
  67. Program; (e) use the Program to develop any other 
  68. computer programs; or (f) permit or authorize anyone else to 
  69. take any action described in this sentence.  Sierra may 
  70. revoke this license at any time by written notice.
  71. Ownership.  All patent, copyright, trademark, trade secret 
  72. and other proprietary rights in and to the Program are 
  73. retained by Sierra and are not sold or transferred to you.
  74. Disclaimer.  You acknowledge that the Program is provided 
  75. "AS IS" and "WITH ALL FAULTS, DEFECTS AND 
  76. ERRORS" and that all use of the Program is AT YOUR 
  77. OWN RISK.  Accordingly, SIERRA WILL NOT HAVE ANY 
  78. OBLIGATION OR BE LIABLE FOR ANY:  (A)  VIRUS, 
  79. BUG, ERROR, OMISSION, DEFICIENCY OR DEFECT IN 
  80. THE PROGRAM; (B) INABILITY TO USE THE PROGRAM; 
  81. (C)IMPLIED WARRANTY OF MERCHANTABILITY OR 
  82. FITNESS FOR A PARTICULAR PURPOSE; OR (D)CLAIM 
  83. IN TORT, WHETHER OR NOT ARISING IN WHOLE OR IN 
  84. PART FROM SIERRA'S FAULT, NEGLIGENCE, STRICT 
  85. LIABILITY, OR PRODUCT LIABILITY (WHETHER 
  86. ACTIVE, PASSIVE OR IMPUTED).
  87. LIMITATION OF DAMAGES.  IN NO EVENT WILL SIERRA 
  88. HAVE ANY OBLIGATION OR LIABILITY (WHETHER IN 
  89. CONTRACT, WARRANTY, TORT (INCLUDING 
  90. NEGLIGENCE) OR OTHERWISE FOR COVER OR ANY 
  91. DAMAGES SUSTAINED BY YOU OR ANY OTHER 
  92. PERSON ARISING FROM USE OR INABILITY TO USE 
  93. THE PROGRAM, INCLUDING WITHOUT LIMITATION 
  94. ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR 
  95. CONSEQUENTIAL DAMAGES (INCLUDING FOR LOST 
  96. PROFITS AND LOST DATA), EVEN IF SIERRA HAS 
  97. BEEN ADVISED OF THE POSSIBILITY OF SUCH

  100. Applicable Law.  THIS AGREEMENT SHALL BE 
  101. INTERPRETED, CONSTRUED AND ENFORCED IN ALL 
  102. RESPECTS IN ACCORDANCE WITH THE LAWS OF THE 
  103. STATE OF WASHINGTON WITHOUT REFERENCE TO 
  104. ITS CHOICE OF LAW RULES.

  106. Entire Agreement.  This User Agreement sets forth the 
  107. entire agreement, and supersedes any and all prior 
  108. agreements, with respect to the Program.
